What is End of Service Gratuity?
According to Qatar Labour Law, End of Service Gratuity is a sum of money stipulated to be paid to an outgoing employee based on the service period. This is calculated based on your employment contract and the number of years you have worked for the company.

Qatar’s Ministry of Labour provides an online service that allows applicants to calculate the end of service gratuity on its official website. However, this page is only available in Arabic.

How To Calculate End of Service Gratuity on Ministry website
You can also calculate the end of service gratuity on the Ministry website by entering your joining date, last working date, basic monthly salary and number of gratuity days due for each year.
Although the service is available only in Arabic, non-Arabic speakers can also easily calculate ESB by following these steps:
STEP 1: Click on this link to open the calculation page. You will see the following fields in Arabic:

STEP 2: In the first field, enter your Date of Joining (as per your contract)
STEP 3: In the second field, enter your Last Working Date
STEP 4: In the third field, enter your Basic Monthly Salary (as per your contract)
STEP 5: In the fourth field, enter the Gratuity Days accrued for each year (for example, 21 days for one year). You have to refer to your contract for this.
STEP 6: Click the bottom button to see the result.
This service was introduced to ensure greater transparency and to make foreign employees aware of their rights.
The end of service gratuity is calculated under the Labour Law No. 14 of 2004.

End of Service Gratuity: What the Law Says
Upon termination of the employment contract, an employee is entitled to end-of-service gratuity and leave salary. Under Article 54 of the Labour Law (Law No. 14 of 2004), the employee is eligible for a minimum of three weeks’ basic salary as the end-of-service gratuity for each year.
As per Article 81 of the said law, if the employment contract is terminated for any reason before a worker takes his annual leave, he shall be entitled to payment instead of annual leave equivalent to his wage for the leave days to which he is entitled [1].
When the employment contract is terminated, the employer is responsible for repatriating the employee back to the place from where he was recruited or any her place agreed by the parties. However, if the worker joins another employer before departure from the country, this obligation shifts to the new employer.
As per Article 54 of Law No 14/2004,
“The Employer shall pay at date of termination the end of service gratuity in addition to any amounts due to the Worker who spent one year or more in employment. This gratuity shall be agreed upon by the two parties, provided that it is not less than a three-week Remuneration for every year of employment. The Worker shall be entitled to gratuity for the fractions of the year in proportion to the duration of employment.”
The worker’s service shall be considered continuous if it is terminated in cases other than those stipulated in article 61 of this Law and returned to service within two months of its termination.
- The last basic salary shall be the base for calculating the gratuity.
- The employer is entitled to deduct from the gratuity any due amount to be paid by the worker. [2]

Is Gratuity Higher If Employee Has Worked For More Than 5 Years?
As per the current law (Law No 14 of 2004), gratuity shall be agreed upon by employer and employee, provided that it is not less than a three-week remuneration for every year of employment.
The clause that says a worker should be paid four weeks/year for working 5-10 years and five weeks/year for more than ten years was part of the old labour law and is not valid anymore [3].
Will Gratuity Be Paid in Case of Worker’s Death?
According to Article 55 of the Labour Law, if the worker dies during the service, regardless of the cause of death, the employer shall deposit with the treasury of the competent court any wage or other entitlements due to the worker in addition to the end of service gratuity within a period not exceeding fifteen (15) days from the date of the death.
The minutes shall contain a detailed report indicating the method of calculating the amounts referred to. The employer shall deposit a copy of the minutes with the Department.
The competent court shall distribute the deposited amounts among the deceased Worker’s heirs in accordance with Islamic Sharia provisions or the Personal Status Law applicable in the deceased Worker’s home country.
If three years have elapsed since the date of the deposit without the person deserving the due amounts being known, the court shall transfer these amounts to the State Public Treasury.
Can the Employer Terminate Employee Without Gratuity?
According to Article 61 of the Labour Law, there are certain situations under which an employer may dismiss an employee without the payment of the end of service gratuity. Instances of such gross misconduct include:
- violation of written instructions pertaining to worker safety
- employee intoxication while at work, and
- disclosure of secret information regarding the employer

It would be grateful if you could answer my following doubts:-
1. If it is 5 years and 40 days, then the gratuity is calculated even for 40 days? or just for 5 years.
2. Employees vacation days included or excluded for calculation gratuity? because if the employee go for vacation they won’t come back for 3 to 4 months.
3. The calculation of gratuity is just 21 days per year? or Is there any increase in days if the service period is more than 5 years?

Hello am Wilson I had acontract with my company for three years and it’s getting finished but I need to change my employer ,I have given anotice period for two months to my employer . because I have got anew offer ( job) to another company of which my new employer needs No objection certificate from my current employer .but my current employer still rejects my resignation letter that I submitted for two months ,what can I do.note ( I don’t have any contract with my new employer)

Regarding the incorrect computation of my annual leave vacation and ticket fare for a 2 way cost.
I am working in my company for 11 years and during my application of vacation. They said that i didnot finished 2 years. There is a 40 days balance to complete. Then they gave less in my settlement. Instead of 30 days per month. They gave me only 51 days for 2 months. Instead of 60 days. Also ticket fare is less. They gave only 2,600 riyals. Instead of 3,600 riyals.
I just wanted to know if the said numbers are all correct?
Please advise me, i need a justification.

Hi Rehmat, It would be difficult to claim gratuity from the old company after several years. You can approach Labour Court and see.

At the end of my 2 years contract I went to Philippines for 2 months vacation and then come back. Im working 11 years in 1 employer only. Hi Chona, Gratuity is not the same as vacation pay. You can claim gratuity even if you were paid during your vacation.

I have my concern about my graduity and other benefits to my company. It’s almost 1 month now I don’t have work and they let us find other job and give us release paper and according to them they will not give my graduity and other benefits because they release me unless I will not find new job and going back to our country. And last week they give me my release already cause I give them my job offer for my new job. Before they give me the Noc they let me sign the quit claim that it’s written there I will not complain and it says there that I get already all my graduity and other benefits and I Don’t have any against with them but the truth is they didn’t yet give my graduity and benefits. I Don thave no choice cause I need to get the noc to start to my new job so I sign the quit claim paper. And the other manager told me that he will pay me if our other manager will get out from jail so till now stilim waiting and I don’t know if they give it or no.. And when I show to our other manager for the graduity they need to pay me cause I’m already 4years and 9months since the day I dont have work. But sad thing is that my manager telling me why it’s so bug the amount he need to pay me and I said I just base the calculation according to the labor and when I said to go in the labor to check the correct calculation he don’t like and told me that he let the hr to calculate it every one year and I told him why he need to calculate it every one year and not the year I finish because I finish 4years and 9months with any vacation. And my question is what is the correct calculation of graduity? And how much should I get for the reimbursement for my ticket since 4yeara I didn’t take my vacation cause they said that if I didn’t take my vacation I will work and they will reimburse my plane ticket. I hope you can answer me and help me for my concern asap cause till now they didn’t give my graduity and still waiting for the other manager to get out from jail. Thank you.
